¿Salud Pública o Derecho a la Libertad?
Si hay una discusión jurídica que nos trajo el virus SARS COVID19, es justamente la discusión respecto de dónde está el límite de la salud pública y comienza el derecho individual de cada uno de nosotros.
En circunstancias normales, tenemos como ciudadanos la posibilidad de vivir nuestras vidas sin intromisiones ajenas, a excepción claro está que con nuestro accionar estemos afectando a terceros. Si nos entrometemos afectando derechos de los demás, lógicamente la respuesta será una intromisión estatal en nuestras vidas para volver a equilibrar la situación.
Ahora bien, en situaciones de crisis el derecho individual a la libertad sufre limitaciones en post de poder resolver la crisis, está limitación o restricción a los derechos se busca que sea temporaria y a los fines de volver las cosas a la normalidad o manejar la situación.
La pandemia ocasionada por el virus SARS COVID 19 no fue la excepción, y en distintos momentos se generaron fuertes restricciones a la libertad. En un principio fue la restricción para circular y evitar que saliéramos de las viviendas para restringir de esta manera el contacto personal y así disminuir el contagio, la utilización de la mascarilla o barbijo y la distancia social en lugares públicos fueron otras medidas en ese sentido.-
Ahora bien, cuando la crisis sanitaria generada por el virus empezó a controlarse, y se pudo iniciar la vacunación contra distintas cepas del virus, al implementarse la obligatoriedad de la vacuna para poder reinsertarnos a las distintas actividades sociales, desde retornar al trabajo presencial, concurrir a lugares públicos y poder viajar, comenzó nuevamente la discusión por el choque entre las facultades estatales para imponer medidas en harás a proteger la salud pública y el derecho individual de cada uno de poder elegir si vacunarse o no.
La discusión en este aspecto tiene varias aristas, pero desde mi punto de vista no tenemos que perder el foco en un aspecto. Si bien en principio el cuidado y nuestra salud sólo nos afecta a nosotros, cuando las enfermedades son virales la negligencia de una persona puede afectar la salud de muchas personas. Y por eso creo que es fundamental que en algunas situaciones o ante determinadas enfermedades prevalezca la salud pública y el intento por preservarla, frente a los derechos individuales.-
Está última discusión, estuvo en auge y fue el foco del conflicto en el conocido Convoy de la Libertad de Canadá (en inglés, Freedom Convoy; en francés, Convoi de la Liberté). Este convoy convoco una serie de protestas activas iniciada por camioneros en Canadá contra los mandatos de vacunación y restricciones sanitarias en el país; concretamente el punto álgido en discusión era la exigencia de vacunación para poder cruzar la frontera, para luego ampliar la discusión a las distintas restricciones sanitarias.-
El convoy inicio el 22 de enero del año en curso, en que cientos de vehículos convergieron de distintos puntos trasladándose hasta Otawa el 29 de enero de 2022 en que se concentraron en el Parlamento. Si bien en un principio desde las autoridades no se le dio importancia a esta concentración, ante la inactividad mostrada fue acrecentándose la cantidad de personas y se fue imitando en distintos puntos del país, generando bloqueos provinciales y de pasos fronterizos, lo que generó importantes trastornos económicos.-
Los manifestantes declararon que no cesarían las protestas hasta que se derogasen todos los mandatos y restricciones sanitarias del COVID-19. Teniendo en cuenta el impacto que fue generando se declaro el estado de emergencia estableciéndose distintas sanciones a los manifestantes que se encontraban participando del convoy tales como congelar las cuentas bancarias y hacerles seguimiento a sus redes sociales. La situación fue in crescendo hasta que finalmente, teniendo en consideración al escalada de medidas tomadas por las autoridades los bloqueos se fueron levantando, y el 23 de febrero del año en curso, casi un mes después, con intervención policial de por medio, finalizaron las protestas en Otawa.-
El convoy ha sido condenado por grupos de la industria del transporte y sindicatos. La Alianza Canadiense de Camiones dijo que un gran número de manifestantes no tenía ninguna relación con el sector. Algunos manifestantes fueron vistos deshonrando el National War Memorial y la Tumba del Soldado Desconocido, y una estatua de Terry Fox fue profanada y después limpiada.1920 Oficiales del gobierno han expresado su preocupación por la relación de algunos manifestantes con grupos de extrema derecha, incluyendo a los que promueven la violencia; y que algunos hayan pedido el derrocamiento del gobierno federal.7 Algunas fuentes han calificado las protestas como una ocupación o un asedio.
Después de una ocupación de tres semanas, se presentaron al menos 533 cargos penales contra manifestantes, incluida al menos una docena por delitos violentos. Los expertos consultados por Le Devoir notaron la presencia de una docena de cargos relacionados con armas, la mayoría de un tipo no especificado, pero al menos dos mencionan específicamente las armas de fuego.
Actualmente se encuentra interviniendo una comisión investigadora para poder dilucidar bien lo ocurrido, estando en el foco de la investigación la intervención no sólo de las autoridades policiales sino también la declaración del estado de emergencia.-
El comisionado de la investigación pública sobre la invocación de medidas de emergencia por parte del gobierno federal también tuvo dificultades para acceder a algunos documentos, dijo el primer día de las audiencias. “El acceso a documentos relevantes ha sido difícil”, dijo el juez Paul Rouleau en su discurso de apertura. Aunque el gobierno ha hecho “esfuerzos considerables” para publicar las miles de páginas de documentación en poder de doce departamentos, compartirlas con la Comisión se ha hecho a cuentagotas. Los últimos documentos llegaron el fin de semana pasado, dijo el comisionado.
El juez Rouleau señaló que muchos de estos documentos están clasificados como secretos por razones de seguridad nacional. Su equipo tuvo que “hacer un esfuerzo considerable” para encontrar una forma responsable de compartir información relevante con el público. Además, se han recibido 50.000 páginas de documentos de provincias y municipios que deben analizarse.
“Esta comisión se está preparando para encontrar respuestas a las preguntas que le dirige el Parlamento: qué llevó al gobierno federal a declarar una emergencia, cómo ejerció los poderes obtenidos y si sus acciones fueron apropiadas”, dijo el juez Paul Rouleau. Estas respuestas deben comunicarse al Parlamento antes del 20 de febrero de 2023.
La Comisión debe primero establecer los hechos y hacer recomendaciones. No es un tribunal y no puede imponer multas o penas de prisión. Si determinara que las medidas de emergencia no estaban justificadas, el gobierno solo incurriría en un costo político.
El gobierno federal también ha encomendado a la Comisión sobre el Estado de Emergencia que examine otras cuestiones, como las motivaciones del Convoy de la Libertad, la contribución de donaciones extranjeras a su crowdfunding, la influencia de la desinformación en línea y el impacto económico de los bloqueos.
Una vez que finalice el proceso, que se encuentra en etapas de celebración de audiencias podremos ver los resultados de la investigación que se viene llevando a cabo.-
